Blue Oak Agro Limited has dragged Chimsoro Farms to court for failing to clear debt totalling US$26,363 for the supply of agriculture inputs obtained in the 2016/2017 farming season.

In a statement of claim filed in the Lusaka High Court, Monday, the plaintiff stated that in 2016, they supplied the defendant agriculture inputs amounting to $43,964, but Chimsoro Farms only made payments totalling $17,200.90 after the 2016/2017 farming season, leaving a balance of $26,363.

The plaintiff stated that they had engaged Chimsoro Farms on several occasions for an amicable settlement of the amount outstanding, but to no avail.

“Between June 27, 2016, and September 9, 2016, the plaintiff supplied the defendant agriculture inputs amounting to $43,964 and that payment was to come from proceeds of the sale of wheat, maize and soya beans from the 2016/2017 harvest season. The input supplies by the input were on three invoices whose details were as follows; (i) invoice one dated June 27, 2016, for $10,400. (ii) invoice two dated July 17, 2016, for $26,184 and (iii) invoice three dated September 2, 2016, for $7,380. Total $43,964,” read the statement of claim.

“The defendant made payments totalling $17,200.90 after the 2016/2017 farming season leaving the balance of $26,363. The plaintiff has engaged the defendant on several occasions for an amicable settlement of the amount outstanding but to no avail. The defendant have either failed or neglected to honour their commitment.”

The plaintiff claims for the sum of $26,363.10, with interest on the sum due and costs.
