Former Director of public prosecutions Mutembo Nchito has pressed on with a subpoena against former chief justices Ernest Sakala and Mathew Ngulube, demanding that the duo appears before the Constitutional Court as witnesses over the manner in which the tribunal that presided over his removal from office conducted its business.

Mutembo has also applied to subpoena tribunal secretary Mathew Zulu who he wants to produce a long list of documents that were used in the Justice Annel Silungwe-led Tribunal that recommended his removal from office to President Lungu.

In an affidavit in support of his application, Mutembo stated that Justice Zulu would also be required to give evidence in relation to the documents produced and the Petition that was before the ConCourt.

Mutembo also explained why he wanted Justice Sakala and Justice Ngulube to be subpoenaed.

“That in relation to Mr Justice E.L Sakala, that he be Summoned and/or Subpoenaed to give evidence on his appointment to the Mutembo Nchito SC Investigative Tribunal set up under the repealed Article 58 of the Constitution, his prior dealings with the Petitioner which were directly connected to the terms of reference of the Mutembo Nchito SC Tribunal, the Petition in general and specifically claims under paragraph 31 iv, v and vi of the Petition,” read Mutembo’s affidavit.

“That in relation to Mr. Justice M. Ngulube, that he be Summoned and/or Subpoenaed to give evidence on his appointment to the Mutembo Nchito SC Investigative Tribunal set up under the repealed Article 58 of the Constitution, his prior dealings with the Petitioner directly connected with the Petitioner’s complaint before the Court, the Petition in general and specifically claims under paragraph 31 iv, v and vi of the Petition. That in any event, these witnesses be required to testify to what they know about the matter before Court.”
