The Livingstone High Court has subpoenaed Diggers Editor Mukosha Funga and reporter Thomas Mulenga to testify in a matter in which losing PF Sesheke candidate Dean Masule petitioned the election of UPND’s Romeo Kangombe.

The subpoena was filed by Masule’s lawyers from Messrs Eric Silwamba, Jalasi & Linyama on April 12, 2019.

“You are commanded in the President’s name to attend before the High Court for Zambia before the Honorable Madam Justice G. Chawatama at Livingstone from the 11th day of April, 2019 at 09:00 hours in the forenoon or soon thereafter from day to day until the above cause is tried, to produce the following document: i)Audio footage of the interview that relates to the article that was published in the NEWS DIGGERS Newspaper dated Thursday, 14th February, 2019 headlined “We will send Lungu, Kampyongo to ICC for crimes against humanity – UPND”, ii) Newspaper article that was published in NEWS DIGGERS Newspaper dated Friday, February 15, 2019 headlined “Sesheke election was not free and fair, there was too much violence – UPND’s Kang’ombe, iii) Audio footage of the interview that relates to the article that was published in NEWS DIGGERS Newspaper dated Friday, February 15, 2019 headlined “Sesheke election was not free and fair, there was too much violence – UPND’s Kang’ombe”,” read the subpoenas.

In the petition, Masule has alleged that Kangombe was not duly elected because the election was characterised with malpractices such as violence and intimidation.
