FORMER Mongu High Court judge Wilfred Muma’s lawyer, James Mataliro, has asked the Economic and Financial Crimes Court to refer a constitutional issue to the Constitutional Court regarding the interpretation of Article 93 of the Constitution, which deals with instructions and decisions of the President. Mataliro made the application before the defence could close its case, arguing that the matter required constitutional clarity before the court could proceed. Muma is facing two charges: willful failure to comply with the law, and abuse of office.
