THE Constitutional Court has dismissed a petition by LCK and Chapter One Foundation challenging government’s failure to submit the Zambia-USA Health Aid MoU and Bilateral Compact Agreement to Parliament for approval. The court ruled that the petition lacked merit because Zambia and the United States had not concluded any agreements, as negotiations had stalled. In this matter, LCK and Chapter One petitioned the State, seeking a declaration that the implementation of the MoU and Bilateral Compact Agreement between the Zambian government and the United States government, relating to health assistance and broader economic cooperation, without approval from the National Assembly, was unconstitutional, null and void.
