FORMER Konkola Copper Mines provisional liquidator Milingo Lungu has asked the Constitutional Court to dismiss Attorney General Mulilo Kabesha’s cross-petition against him, saying the AG is not a “person” capable of lodging it. Lungu argues that by exercising powers which she derives from the Constitution to grant him immunity from prosecution, the DPP acted on behalf of the State and therefore, her actions bind the State. He argues that as such, the State cannot be heard to challenge its own actions.
