LAWYERS representing former Konkola Copper Mines provisional liquidator Milingo Lungu have asked the Constitutional Court to dismiss Attorney General Mulilo Kabesha’s cross-petition against the Immunity Agreement signed between the suspended DPP and their client. They have submitted that the cross-petition by the AG, to the extent that it seeks to challenge the constitutionality of the decision of the DPP to enter into a non-prosecution agreement with Lungu, is misconceived. But the State has argued that the mere fact that the DPP, as an officer, was party to the Immunity Agreement signed with Lungu doesn’t mean that the Attorney General should shy away from challenging that decision.
