THE decision by the State to enter a consent judgement with former Director of Public Prosecutions Mutembo Nchito SC and to compensate him for being unconstitutionally removed from office has raised some eyebrows among people who did not follow the matter closely. According to the consent agreement, the State has admitted that Mutembo’s “constitutional right was infringed when he was subjected to a conflicted and biased Tribunal, which recommended his removal from office as DPP”. In order to avoid reinstating Mutembo back in office, the State has also agreed to compensate him for “his unconstitutional and unjust removal from a constitutionally protected office which he was entitled to retain until the retirement age of 60”.
