THE Supreme Court yesterday quashed a 2014 decision of the Kasama High Court sentencing a man of Luwingu, Davies Chishala to death by hanging for murder. Supreme Court Judge Evans Hamaundu held that the prosecution did not prove beyond all reasonable doubt that Chishala murdered Mulamba, and he consequently acquitted him. In 2014, then Ndola High Court judge-in-charge Isaac Chali, sitting in Kasama convicted and sentenced Chishala and Tony Nyemba for murdering Frederick Mulamba. It was alleged that Chishala and Nyemba murdered Mulamba on December 5, 2012 in Luwingu. It was further alleged that the duo assaulted the deceased as they were drinking some locally brewed alcohol.
