THE State has asked the Lusaka High Court to determine whether Horizon Education Trust’s application for assessment of compensation, which was commenced by way of summons as opposed to by way of a notice, should be dismissed for procedural impropriety. The State wants if the answer is that Horizon’s assessment of compensation commenced by way of summons, was improperly before court, a determination of whether the court has jurisdiction to hear and determine the assessment for compensation. This is a matter in which Horizon Education Trust sought judicial review over the President’s decision to compulsorily acquire stand number KABUL-N69565/196, Kabulonga, which hosts the school.
