GOVERNANCE activist Isaac Mwanza and another have petitioned the Constitutional Court seeking an order to quash all recommendations and appointments of judges as announced by State House last month. Mwanza and Maurice Makalu, who have cited the Attorney General as the respondent, want a declaration that the recommendation, appointments and promotion of judges of superior courts by the Judicial Service Commission are unconstitutional for breach of Articles 8(d) (e), 173 (1)(i)(j) and 210 (1) and hence invalid. The two want an order directing the Judicial Complaints Commission to conduct a transparent, competitive recruitment system of judges through advertisement and interviews based on principles in Articles 8(d)(e) and 173 (1)(i)(j) of the Constitution.
