ATTORNEY General Mulilo Kabesha has defended the temporary closure of courts in August, saying the State could not wait for the seriousness of the security risk to become apparent before taking precautionary measures. Meanwhile, Kabesha says there is no constitutional requirement for security agencies to disclose full details of security threats to individuals, institutions or State organs. In this matter, Chapter One Foundation (COF) petitioned the Constitutional Court seeking a declaration that last month’s three-day closure of judicial complexes across the country was unconstitutional and unlawful. COF is also seeking an order declaring that measures taken by law enforcement and security agencies which prevented access to judicial services were unconstitutional.
