The Kitwe Magistrates’ Court has sentenced a 50-year-old Garden boy of Mulenga Compound to 36 months imprisonment with hard labour for stealing a suitcase containing assorted items worth K15,000.
The father of 10 and husband of two women told the court that he accidentally stole the items from his Indian boss.
This is a case in which Harrison Musonda is charged with theft by servant contrary to the laws of Zambia.
Particulars of the offense were that on April 15, 2019, in Kitwe, the accused person stole one suitcase, two T-shirts, two pairs of trousers, one Indian grade 12 certificate, one Zambian Diploma, five pairs of socks, one bottle of perfume and K9,000 cash, all valued at K15,000, the property of Danish Kaan.
Appearing before Senior Resident Magistrate Osward Chibalo for plea, the accused person pleaded guilty to the offence of theft by servant.
And magistrate Chibalo said upon the accused persons own admission of the offence, he had found him guilty as charged and was convicting him accordingly.
And in mitigation, the accused person begged the court to exercise leniency for he was Epileptic.
He said he was also taking care of his 71-year-old mother and that his children would suffer if jailed.
But magistrate Chibalo said he was sentencing him to 36 months with hard labour and if he was not happy with the sentence, he had a right to appeal within 14 days.
