A JUDICIAL Complaints Commission report has revealed that the commission recommended the dismissal of three ConCourt judges based on the manner they conducted themselves in the 2016 presidential election petition. The report indicates that the former judges Anne Sitali and Mungeni Mulenga privately ‘convened’ without the permission of the judge president, and wrote a judgement on a weekend to dismiss the 2016 presidential petition when it was supposed to proceed to trial. Meanwhile, in her defence, Judge Mulenga told the commission that Justice Hildah Chibomba, who was the Constitutional Court president at the time, gave them permission to write their opinions on the matter of jurisdiction, hence the decision to write the opinions over the weekend.
