THE enactment of the Criminal Procedure Code Act No. 4 of 2026, has been received with mixed emotions by various stakeholders. The Act makes sexual offences such as defilement, rape and incest non-bailable. The legislation, which was assented into law on March 31, 2026, includes other offences that are non-bailable such as stealing medicine, medical supplies, copper, diamond and gold. Stealing railway, aircraft, vessels, traffic sign and navigation marks have also been made non-bailable in the Act. However, the Act states that a person who knowingly issues a false statement in an affidavit or certificate in a criminal proceeding commits an offence and is liable, on conviction, to a fine not exceeding five hundred thousand penalty units or to imprisonment...
