FORMER Kwacha and Kabushi PF members of parliament Joseph Malanji and Bowman Lusambo have dragged the Electoral Commission of Zambia (ECZ) to court, seeking an order that it should hold fresh nominations for the two constituencies. The two have argued that ECZ’s decision to reject their nominations was illegal as they were never disqualified by the Constitutional Court, either in its judgement or otherwise. Malanji and Lusambo want the Lusaka High Court to declare that the decision of the returning officer, as the agent of ECZ, to reject the duly compiled nomination papers because of the nullification of their elections, was illegal, procedurally improper and was therefore null and void.
