PF faction Secretary General Raphael Nakacinda has dragged Director of Public Prosecutions Gilbert Phiri to the Lusaka High Court over his decision to deny him consent to privately prosecute Miles Sampa and Morgan Ng’ona. Yesterday, Lusaka Magistrate Keagan Litiya said he had no authority to overturn his earlier decision to dismiss Nakacinda’s perjury and forgery complaint against Sampa and Ng’ona, after Phiri declined to grant consent to privately prosecute the case. Nakacinda has now commenced a new case before the Lusaka High Court in which he is seeking leave of the court to challenge Phiri’s decision to refuse to grant him consent to privately prosecute the matter.
