FIVE UPND members have sued the State in the Lusaka High Court, seeking damages for false imprisonment. Patrick Mwalula Mucheleka, Elias Mubanga, Samuel Ngwira, Chinyimba Bwalya, Kelvin Kalusha Bwalya, were arrested on September 13 and were detained for 31 days. The five UPND members are also seeking aggravated and exemplary damages for malicious prosecution, assault, mental distress, mental anguish, emotional distress, inconvenience and embarrassment. In a statement of claim filed in the Lusaka High Court Principal Registry, by Messrs PNP Advocates, the five UPND members stated that while in detention at Kasama Police Station, Kelvin Bwalya was tortured and sustained injuries.
