FORMER Secretary to the Treasury Fredson Yamba has dragged a magistrate to the Lusaka High Court seeking a declaration that the Subordinate court’s decision to dismiss his application to have his charge sheet quashed or amended is a violation of his right to a fair trial. Yamba, who has also sued the Attorney General, is jointly charged with former Foreign Affairs Minister Joseph Malanji with failure to comply with laid down procedures before the Lusaka Magistrates’ Court. He wants the court to determine and declare that his right to be informed in detail the nature of the offence pursuant to which he is charged as guaranteed under Article 18 (2) of the Constitution was being violated by the magistrate.
