THE State has submitted to the Constitutional Court that it only negotiated with Milingo Lungu to resign from his position as KCM Provisional Liquidator, adding that at no time did any government agent issue a written or verbal instruction to the DPP to either enter a nolle prosequi or Immunity Agreement in his favour. Attorney General Mulilo Kabesha has argued that he only discovered the existence of the Immunity Agreement signed between Lungu and the Director of Public Prosecutions in the Court documents forming part of Lungu’s petition, and he had no knowledge of its existence before.
