CONSTITUTIONAL lawyer Tresford Chali has petitioned the Lusaka High Court, challenging the constitutionality of the Criminal Procedure Code (Amendment) Act No. 4 of 2026, which removes bail for rape, defilement and incest offences. Chali argues that the removal of bail for sexual offences will automatically presume an accused person guilty, adding that they will serve a prison sentence before their side of the story is heard.
