Mount Meru Millers Zambia Limited has sued Dahamos Distributors Limited in the Lusaka High Court, demanding payment of over K2 million for the cooking oil supplied to the company.
In a statement of claim filed in the Lusaka High Court, Mount Meru stated that it was in the business manufacturing edible oils and stock feed.
It stated that under oral agreement entered between Mount Meru Millers Zambia Limited and Dahamos Distributors Limited, the latter obtained cooking oil from the former up to a limit K700,000, adding that Dahamos Distributors was supposed to pay for the cooking oil after a period of 30 days.
Mount Meru further stated that Dahamos Distributors deposited bank transfer advice slips in their bank, which indicated that Dahamos had advised their bank to transfer K700,000 into Mount Meru’s account.
“Dahamos Distributors Limited deposited bank transfer advice slips in Mount Meru Millers Zambia Limited’s bank. The bank transfer slips indicated that Dahamos Distributors Limited had advised their bank to transfer K700,000 into Mount Meru Millers Zambia Limited’s account. The K700,000 transaction was supposed to be for the cooking oil that Mount Meru Millers Zambia Limited would supply to Dahamos Distributors Limited,” read the statement of claim.
It stated that it then proceeded to supply and deliver the cooking oil to Dahamos Distributors Limited, but added that despite Dahamos’ purported bank transfer advice slips; there was no money, which was transferred into their bank account.
“Despite Dahamos Distributors Limited’s purported bank transfer advice slips, there was no money, which was transferred into Mount Meru Millers Zambia Limited’s bank account,” the statement further read.
Mount Meru disclosed that as at March 30 this year, Dahamos Distributors owes it K2,077,159 for the supply and delivery of cooking oil.
“Despite several reminders and meetings, Dahamos Distributors Limited has neglected or refused to pay the K2,077,157 due to Mount Meru Millers Zambia Limited. By reason of the defendants [Dahamos Distributors Limited] actions, the plaintiff [Mount Meru Millers Zambia Limited] has suffered loss and damages,” read the statement of claim.
Mount Meru is now claiming K2,077,157 due from Dahamos Distributors Limited for the cooking oil supplied to it between June 1 last year, and March 30 this year, as well as costs.
