ATTORNEY General Mulilo Kabesha has asked the Constitutional Court to dismiss the Tonse Alliance’s petition regarding former president Edgar Lungu’s eligibility to participate in future elections. Kabesha maintains that the Constitutional Court was in order to pronounce itself as it did in the case of Michelo Chizombe versus Edgar Lungu and two others. In this matter, the Tonse Alliance argued that the Constitutional Court’s decision to declare Lungu ineligible before he could even lodge his nomination papers contravenes Article 52(4) of the Constitution, which stipulates that such a determination must be done after a person files their nomination papers.
