LUSAKA Chief Resident Magistrate Davies Chibwili has asked the Constitutional Court to strike him out as a party to proceedings in which Munir Zulu has petitioned the Court, seeking a stay of a judgement that he is guilty of defaming two ministers and another. Magistrate Chibwili recently found Zulu guilty of defaming Finance Minister Dr Situmbeko Musokotwane, his infrastructure counterpart Charles Milupi and Engineer Mulchand Kuntawala. Magistrate Chibwili has told the Constitutional Court that he was merely performing his judicial functions in the matter. Meanwhile, the State has also asked the ConCourt to strike out Magistrate Chibwili as a party, arguing that the correct party to sue is the Attorney General.
