THE state has submitted to the Lusaka High Court that the matter in which 10 UPND members are seeking K10 million as compensation for false imprisonment is an abuse of court process. Etambuyu Mutonga, an advocate in the Attorney General’s chambers, has stated that this is because there is already a similar action before another judge involving the plaintiffs. Mutonga has asked the court to determine whether this is not a proper case to dismiss the matter with costs to the defendant for multiplicity of actions and abuse of court process.
