Pearl of Health Hospital has asked the Lusaka Magistrates’ Court to dismiss a charge of supplying expired medicines that it has been slapped with.
When the case came up yesterday, the Pearl of Health legal counsel Raymond Musumali asked magistrate Felix Kaoma to dismiss the case as the indictment does not disclose a reasonable offense.
The company submitted that the Zambia Medicines Regulatory Authority (ZAMRA) had no authority under the provisions of the Medicine and Allied Substances Act No3 of 2013 to lodge a complaint against the hospital arising out of the activities of the pharmacy which operates under the hospital.
ZAMRA then asked for time to respond to the application.
Hospital Managing Director Professor Ataur Rahman was in attendance.
Particulars of the offense are that on July 19, 2017 the hospital supplied one expired bottle of Neopeptine Liquid to Patricia Banda Mwiinga without lawful authority.
The matter comes up on September 4, 2017.
