THE State has insisted that the Constitution clearly defines offences against the order of nature and prescribes the penalties for those found wanting of the offence. The State has also told the Constitutional Court that sex is to be done by a man and a woman for the purpose of procreation. This is in a matter where an activist and a Civil Society Organisation have petitioned the State in the Constitutional Court to clarify the expression “the order of nature” with regard to sexual activities.
