THE Constitutional Court has dismissed former Konkola Copper Mines provisional liquidator Milingo Lungu’s application to subpoena witnesses in his case. The court has noted that the documents which were to be produced by some of the proposed witnesses were immunity agreements that they allegedly entered into at some point in their lives, which the court says are not connected to the matter at hand. This is a matter in which Lungu has petitioned the Constitutional Court, seeking a declaration that the purported arrest and commencement of criminal proceedings against him following his re-arrest was an abuse of criminal proceedings since the DPP (former DPP Lilian Siyunyi) granted him immunity against prosecution.
