THE state has told the Lusaka High Court that the arrest of Small and Medium Enterprise Minister Elias Mubanga, Permanent Secretary for Special Duties Patrick Mucheleka and three other UPND members in 2020 for aggravated robbery was justifiable. Enock Mwinda, 51, a District Criminal Investigations Officer at Kasama Police Station, told the court that the five individuals were not falsely imprisoned. Mubanga, Mucheleka, Samuel Ngwira, Chinyimba Bwalya and Kelvin Kalusha Bwalya have sued the state, demanding damages for false imprisonment. The five UPND members are seeking aggravated and exemplary damages for malicious prosecution, assault, mental distress and anguish, inconvenience, and embarrassment suffered during their detention at Kasama Police Station.
