WE raised concern in our opinion yesterday, that the institution that is supposed to autonomously conduct elections in the country appears to be taking one side of the dispute on Article 52 (6) of the Constitution. We take note of the remarks by the ECZ board chairperson Mrs Mwangala Zaloumis who says the Article in question is vulnerable to abuse. Our argument is that there is no law that is not open for abuse. Any law can be abused. Currently, the provision in the law on consent agreements is being abused, and so is the non-conviction forfeiture of assets; but we cannot say these laws must be removed from the statutes on that basis.
