THE Ministry of Agriculture has submitted to the Lusaka High Court that the decision to cancel a fertiliser tender with regards to four suppliers cannot be subject of judicial proceedings. The ministry stated that the four suppliers failed to give full and frank disclosure of the specific law the ministry failed to follow in the bidding process. This is a matter in which four suppliers have dragged ZPPA and the Ministry of Agriculture to court over government’s decision to terminate a fertiliser tender after being recognised as the Best Evaluated Bidders. The four firms are also challenging the move by the ministry to use the direct bidding procedure.
