THE Lusaka High Court has struck out a matter in which Emmanuel Jay Banda sued the state, Levy Ngoma, Clayson Hamasaka and Trevor Mwiinde, seeking damages for his abduction. According to an order endorsed by Justice Mwape Bowa, the case was struck out from the active cause list due to the failure of Banda’s lawyers to make an appearance. Justice Bowa ordered that Banda had 30 days to restore the petition, failure to which it would be dismissed for lack of prosecution. “This matter came up for a status conference and hearing of the petitioner’s application for a conservatory order this morning.
