Mapenzi Chibulo’s father has asked the Lusaka High Court to enter a default judgment in his favor in a case in which he is seeking damages for his daughter’s death.
Mapenzi, a UPND supporter, was allegedly shot dead by the police after the cancellation of the UPND rally on July 8, 2016 which was scheduled to be held in Lusaka’s Chawama township.
In this matter, Douglas Chibulo sued the Attorney General over the death of his daughter, claiming damages for loss of life due to what he termed negligence by police.
But the Attorney General has not yet filed a defense prompting Douglas to ask the court for a default judgement.
Douglas said the Attorney General had neglected to file defense and did not also file an application for extension in which to enter appearance and file defense as well as well as to give reasons for the delay as provided for in the order of directions issued by High Court judge Pixie Yangailo.
In a statement of claim, Douglas stated that the police carelessly, in their effort to disperse people who were peacefully parading in a match past, used live ammunition to shoot at unarmed citizens.
Chibulo further argued that his daughter was murdered in cold blood after sustaining a bullet injury in her skull adding that Mapenzi’s death was caused by gross negligence of police officers as they used live ammunition on innocent citizens.
The Lusaka Magistrates’ Court had sent back the case to police for further investigations after a failed inquest to ascertain the actual killer.
