THE 81-year-old man who was acquitted by the Lusaka Magistrates’ Court of drug trafficking charges has petitioned the Constitutional Court seeking damages for his arrest, detention and prosecution. Tie Mwape, who has cited the Attorney General and the Drug Enforcement Commission (DEC) as first and second defendants, respectively, is demanding an order that his arrest, prosecution, and conviction without establishing the content of Delta 9 tetrahydrocannabinol (THC) in the substance allegedly found in his possession was unconstitutional, illegal and void.
