CONSTITUTIONAL lawyer John Sangwa says it was completely irresponsible and unconstitutional for the JCC to interrogate the Constitutional Court’s decision in the 2016 presidential petition, arguing that it has no powers to do so. And Sangwa says while he had questioned the qualifications of ConCourt judges in the past, he did so before their appointment, adding that his argument was purely a legal opinion and not the law. He adds that the effect of the JCC’s finding that former judges Anne Sitali, Mungeni Mulenga and Palan Mulonda were unqualified is that all decisions made by them since 2016 would have to be vacated.
